NEAR & MEET – PRIVACY POLICY

This Privacy Policy explains how M&P AD, UIC/EIK 208641686, registered at Sofia, Sava Mihaylov, 136, Bulgaria (“Near & Meet”, “we”, “us”, or “our”), collects, uses, stores, shares and protects personal data when you use the Near & Meet mobile application, website and related services.

For purposes of the EU General Data Protection Regulation (“GDPR”), M&P AD is the data controller unless otherwise stated.

1. PRIVACY PRINCIPLES

Near & Meet is designed around voluntary social visibility.

You decide when you want to participate in nearby discovery.

Having the application installed does not mean that you are permanently visible.

The Discoverable setting allows you to control whether your profile may be shown to other users through supported discovery functionality.

We seek to collect only information reasonably necessary to operate, secure and improve the Service.

We do not sell personal data.

We do not use continuous GPS tracking as part of the current Nearby functionality.

2. INFORMATION WE COLLECT

2.1 Account and authentication information

2.2 Profile information

Depending on the information you choose or are required to provide, we may process:

Current connection intents may include:

Dating, Friends, Activities, Networking or No Intent.

Approach Preference may include:

Chat First, Open to Approach or No Preference.

Your exact date of birth is used for account and age-related purposes and is not intended to be publicly displayed.

Where the Service provides an age-display control, your age may be shown only according to your selected setting.

3. INFORMATION VISIBLE TO OTHER USERS

When you enable Discoverability or join an eligible Venue or Event session, selected profile information may be displayed to other users.

Depending on your settings and the current product configuration, visible information may include:

your username or chosen display name;

profile photograph;

biography;

age, if you choose to display it;

gender or other profile information configured for display;

interests and sub-interests;

your current connection intent; and

your Approach Preference.

Your email address, password/authentication credentials and exact date of birth are not intended to be shown to other users.

Turning Discoverability off prevents new Nearby discovery according to the Service’s normal operation, but it does not automatically delete previous conversations, accepted connections, reports or other data already generated through your use of the Service.

4. BLUETOOTH AND PROXIMITY DATA

Near & Meet may use Bluetooth and related operating-system functionality to detect compatible Near & Meet users or sessions in approximate physical proximity.

Depending on the technical implementation, we may process:

Bluetooth signals do not provide a guaranteed exact physical distance.

The current Near & Meet proximity functionality is not designed to create a continuous GPS movement history.

We do not use precise GPS location for Nearby discovery unless a future feature separately introduces such processing, clearly explains it and obtains any permission required by applicable law or platform rules.

Where technically feasible, raw Bluetooth discovery information is processed transiently and retained only for as long as necessary to operate and secure the relevant session.

5. VENUE AND QR SESSION DATA

If you voluntarily join a Venue or Event using a QR code, access code or similar method, we may process:

This information can reveal that you chose to participate in a Near & Meet session associated with a particular venue or event.

A Venue session is not the same as continuous location tracking.

We do not disclose your private account information or private messages to Venue operators merely because you joined a Venue.

Where Venue partners receive statistics, we aim to provide aggregated or de-identified information unless another form of data sharing is separately disclosed and legally permitted.

6. COMMUNICATIONS AND USER-GENERATED CONTENT

When you interact with other users, we may process:

Message content may be stored so that the chat functionality and chat history can operate.

If a message or account is reported, relevant content and surrounding information may be reviewed and retained where reasonably necessary to investigate the report, protect users, enforce our Terms or comply with law.

7. BLOCKING AND SAFETY INFORMATION

When you block another user, we process the relevant account identifiers and blocking relationship so that we can restrict future interaction.

When you submit a safety report, we may process:

9. DEVICE AND TECHNICAL INFORMATION

We may automatically process limited technical information necessary to provide, secure and maintain the Service, including:

We use this information for reliability, cybersecurity, fraud prevention, troubleshooting and service improvement.

We do not use persistent device identifiers for undisclosed tracking.

10. PROFILE PHOTOGRAPHS AND DEVICE MEDIA

If you choose to upload a profile photograph, we process the image you select or capture.

Where supported by the operating system, Near & Meet should use platform photo-selection functionality so that users can select the image they wish to provide without giving unnecessary access to the entire photo library.

We do not use profile photographs for biometric identification or facial recognition unless such functionality is separately introduced, disclosed and lawfully implemented.

11. HOW WE USE PERSONAL DATA AND OUR LEGAL BASES

We process personal data for the following purposes.

Providing the Near & Meet service

This includes creating and maintaining accounts, displaying selected profiles, providing Nearby discovery, Venue participation, connection requests, chat, blocking and notifications.

Legal basis: performance of our contract with you under Article 6(1)(b) GDPR.

Maintaining safety and preventing abuse

This includes detecting spam, investigating reports, enforcing blocks and Terms, preventing fraud and protecting users and infrastructure.

Legal basis: our legitimate interests under Article 6(1)(f) GDPR in maintaining a secure and trustworthy Service and, where applicable, compliance with legal obligations.

Communications and support

We use account contact information to respond to support requests and provide important account, security and service information.

Legal basis: performance of the contract, legitimate interests and, where applicable, legal obligations.

Improving reliability and performance

We may analyse technical and operational data to identify errors, improve performance and maintain service reliability.

Legal basis: legitimate interests under Article 6(1)(f) GDPR.

Device permissions and optional processing

Where applicable law requires consent for a particular permission or processing activity, we rely on your consent under Article 6(1)(a) GDPR.

You may withdraw consent through the relevant app or device setting. Withdrawal does not affect processing lawfully carried out before withdrawal.

Legal compliance

We may process information where necessary to comply with applicable laws, lawful orders, child-safety obligations or valid requests from competent authorities.

Legal basis: Article 6(1)(c) GDPR.

12. CONNECTION INTENT AND APPROACH PREFERENCE

Your selected Connection Intent and Approach Preference are part of the social context you voluntarily provide through Near & Meet.

They are designed to help other users understand the general type of connection or first-contact method you currently prefer.

An Approach Preference is not legal consent to physical, romantic or sexual activity.

Selecting “Open to Approach” does not remove your right to refuse or end any interaction at any time.

We do not use these fields to infer sensitive personal characteristics beyond the purpose of providing the feature.

13. HOW WE RECEIVE INFORMATION

Most personal data is obtained directly from you when you:

create or update an account;

complete your profile;

change Discoverability;

select your interests, intent or Approach Preference;

join a Venue;

send or receive messages;

block or report another user;

contact support.

Technical information may be generated automatically when your device communicates with the Service.

14. WHO WE SHARE DATA WITH

We may disclose personal data only where reasonably necessary for the purposes described in this Policy.

Other Near & Meet users

Information that you choose to make visible may be displayed to eligible users when Discoverability is enabled or when you participate in a Venue.

Messages are shared with the intended recipient.

Infrastructure and service providers

We may use trusted processors for services such as:

cloud hosting and storage;

database infrastructure;

transactional email;

push notifications;

security and anti-abuse systems;

technical support;

crash diagnostics and service monitoring.

Our current cloud infrastructure may include Amazon Web Services (AWS).

Operating-system notification providers such as Apple and Google may process technical information necessary to deliver push notifications.

Service providers process information under contractual and security obligations appropriate to their role.

Legal and safety disclosures

We may disclose information where reasonably necessary to:

comply with law;

respond to lawful requests;

protect users;

investigate fraud or abuse;

protect our legal rights;

address serious safety incidents; or

report child sexual abuse and exploitation where required.

Business transactions

If Near & Meet or its business is reorganised, merged, financed, acquired or transferred, relevant personal data may be transferred subject to applicable data-protection requirements.

We do not sell personal data.

15. INTERNATIONAL DATA TRANSFERS

Some service providers or their subprocessors may process information outside Bulgaria or the European Economic Area.

Where GDPR applies and personal data is transferred to a country without an applicable European Commission adequacy decision, we use appropriate safeguards where required, such as Standard Contractual Clauses or another lawful transfer mechanism.

Where possible, we select European hosting or processing regions appropriate to the Service.

16. DATA RETENTION

We keep personal data only for as long as reasonably necessary for the purposes for which it was collected.

Unless a longer period is required for legal, safety or security reasons:

Account and profile data: retained while the account remains active.

Messages and communication history: retained while necessary to provide chat history and account functionality, and deleted or anonymised following account deletion subject to safety/legal exceptions.

Nearby and Venue session information: retained for up to 15 days, after which it is automatically deleted.

Security logs: generally retained for up to 12 months unless a longer period is necessary to investigate an incident.

Safety and moderation records: may be retained for up to 24 months, or longer where necessary for serious safety matters, repeated abuse, legal claims or legal obligations.

Support records: may be retained for up to 24 months after resolution where reasonably necessary for continuity, disputes or compliance.

Backups: deleted data may remain in encrypted backup systems for up to 90 days before normal backup rotation removes it.

Where information must be retained after account deletion for a legitimate legal or safety reason, we restrict its use to that purpose.

17. ACCOUNT AND DATA DELETION

You may request deletion of your Near & Meet account at any time.

You may initiate deletion through:

Settings → Account → Delete Account

or through the dedicated web resource:

We may require reasonable re-authentication to protect your account from unauthorised deletion.

Following a valid deletion request, we aim to delete or irreversibly anonymise active account data within 30 days, unless specific information must be retained for a lawful reason.

Backup copies may remain for up to 90 days as part of normal secure backup rotation.

Deletion of the account includes associated user-generated content under our control except where retention is legally permitted or required.

Logging out, disabling Discoverability or temporarily disabling an account is not the same as account deletion.

18. YOUR GDPR RIGHTS

Where GDPR applies, you may have the right to:

We may request reasonable information to verify your identity before fulfilling a request.

For users in Bulgaria, the competent supervisory authority is the Commission for Personal Data Protection (CPDP / Комисия за защита на личните данни). You may also have the right to complain to the supervisory authority in your EU/EEA country of residence or work.

19. SECURITY

We use appropriate technical and organisational safeguards designed to protect personal data against unauthorised access, alteration, disclosure, loss or destruction.

Measures may include:

encryption in transit;

access controls;

restricted administrative permissions;

secure authentication practices;

logging and monitoring;

secure cloud infrastructure;

backups;

security updates; and

incident-response procedures.

No internet-connected service can guarantee absolute security. Users should protect their credentials and report suspected unauthorised access promptly.

20. CHILDREN

Near & Meet is intended only for adults aged 18 or older.

We do not knowingly permit persons under 18 to maintain an account.

If we become aware that a minor has created an account, we may suspend the account and delete the relevant personal data, subject to legal and child-safety requirements.

We maintain a zero-tolerance policy toward child sexual abuse and exploitation.

21. SPECIAL-CATEGORY DATA

Near & Meet does not intentionally require users to provide special-category personal data such as health information, religious beliefs, political opinions or biometric identifiers.

Users should avoid including unnecessary sensitive information in biographies or messages.

Profile photographs are not used for biometric identification under the current Service.

We do not intentionally infer sexual orientation, health status, political beliefs or other special-category characteristics from profile information.

22. MARKETING AND ADVERTISING

We do not sell personal data.

Under the current Service, we do not use Near & Meet profile information or private messages for third-party behavioural advertising.

If we introduce materially different advertising or marketing practices in the future, this Privacy Policy and the relevant app-store disclosures will be updated before such processing begins, and consent will be obtained where legally required.

Transactional, security and service emails are not marketing communications.

23. AUTOMATED DECISION-MAKING

Near & Meet may use automated technical processes to provide discovery, filtering, security, spam prevention and service functionality.

We do not currently make solely automated decisions that produce legal effects or similarly significant effects on users within the meaning of Article 22 GDPR.

24. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy when our Service, data practices, technology or legal obligations change.

Where changes materially affect how personal data is processed, we will provide appropriate notice.

The latest version will display the current effective date.
